General terms and conditions of sale

- VIGILO belongs to a Spanish company, SEAMTRACK SL, registered with the Commercial Registry of Madrid under tax identification number ESB85869915 and with its registered office at Calle Francisco Alonso 6, Centro de Empresas Boadilla, 28660 Boadilla del Monte, Madrid, Spain.
- SEAMTRACK SL trades under the name SEAMTRACK (hereinafter, SEAMTRACK) through this website (hereinafter, the “Website"). Scope of application
- These Terms and Conditions of Contract apply to all device orders placed through the website.
- These Terms are the only ones applicable to purchases made through the Website and no other term and/or condition shall apply under any circumstances. - By ticking the "I have read and accept the Terms and Conditions” box on the order form, you accept and undertake to comply with these Terms.
- SEAMTRACK reserves the right to modify these Terms at any time and without prior notice. However, such changes shall have no effect on orders placed before the Website Terms were modified.
User registration - To place an order with SEAMTRACK you must register as a customer by providing your email address as your user ID and a password, together with your billing and delivery address, contact telephone number and date of birth.
You will confirm that you are a natural person of legal age with the capacity to enter into contracts and that you are placing the order as a consumer.
You may also register on the Website as a user at any time without placing an order.
- You are responsible for the use of your password, that is, for keeping your password and account details secret. The password is confidential and may not be shared with third parties. Please note that any third party who knows your password will be able to place orders in your name. If you forget your login details, you may ask SEAMTRACK to send you a new password.
- SEAMTRACK accepts no liability for damage caused by the misuse or loss of the password.

Accuracy of the information
All information provided by the User through the Services must be truthful. To this end, the User guarantees the authenticity of all data communicated when completing the forms required to subscribe to the Services. Likewise, it is the User's responsibility to keep all information provided to SEAMTRACK permanently up to date so that it reflects the User's actual situation at all times. In any event, the User shall be solely responsible for any false or inaccurate statements they make and for any harm caused to SEAMTRACK or to third parties by the information they provide.

Images on the WEBSITE
The images on the Website aim to show the actual product as accurately as possible, which is why 360º images are available for most models. However, there may be slight variations in the colour or brightness of the products due to a range of environmental factors. The images shown have no contractual value.

Completing your purchase
We currently offer the following payment options:
• Credit and debit card
• Bank deposit or transfer within Spain
The purchase process involves the following steps:
-The purchase process begins with the selection of the device model and quantity. If you wish, and indicate this by clicking the “Save” option, SEAMTRACK will store, for a reasonable period of time, the details you enter during the purchase process, provided you have previously registered as a customer. You must then complete the order form, stating the delivery address for the devices and your payment details, among other information. These steps are simplified if you have previously registered as a customer. Payment may be made by credit or debit card or by bank transfer. Once the payment order charged to your credit card has been confirmed and verified, SEAMTRACK will send you an email confirming your purchase.
The invoice for your purchase will be available in “My Account” for a minimum period of one year.
We recommend that you print and keep a copy of these Terms, of your Purchase Confirmation and of the invoice as proof of purchase.

Prices
- Prices are those stated on the website, except in the event of an obvious error.
-Prices are expressed in the local currency of the country. -SEAMTRACK may change prices at any time before your order request is received.
- The services will be provided by SEAMTRACK once the purchase has been confirmed and payment has been made.
Orders within mainland Spain and the Balearic Islands are sent by courier with express 24/48-hour delivery. Shipments to the Canary Islands, Ceuta and Melilla are sent by registered/express post. International shipments are also sent by courier.
When your order is dispatched we send you an email with the tracking number so that you can check the status and delivery time with the courier.

Delivery, shipping and transfer of risk
Where the goods are available, the Seller will ship them as quickly as possible, that is, within 1 to 14 working days. If the goods are not in stock, the Seller will ship them as soon as possible, depending on the manufacturer's availability. The delivery time is subject to the Seller's availability of the goods, which in turn depends on the manufacturer delivering the goods correctly and within the expected time. In special, isolated cases, delivery may be delayed by a maximum of 4 weeks.
If shipping proves impossible for reasons outside the Seller's control, the contract shall be deemed fulfilled once the Customer has been informed that the goods have been made available. Delivery times may be delayed in the event of force majeure, transport or operational problems, strikes, shortages of raw materials or similar circumstances. If the delay extends beyond four weeks from the date on which the contract was concluded, either party reserves the right to terminate the contract.
If the goods ordered are not available, the Seller reserves the right to make partial deliveries, bearing the resulting costs, provided that the Consumer agrees to this.

Product returns and 100% Guarantee
- To cancel your request, you must notify SEAMTRACK in writing at the following address: info@seamtrack.es.
- If you decide to cancel your order after receiving the devices, you may obtain a refund of the price of the product provided that:
(i) You notify SEAMTRACK of your decision within fourteen (14) calendar days of the product delivery date, by message sent to the address indicated above; (ii) You return the devices to SEAMTRACK in perfect condition, sending them at your own cost and risk by registered post to the address we provide once you have contacted us.
-If the return is due to the product being faulty, you may choose between (i) returning the product received to SEAMTRACK and obtaining a refund of the amount paid; or (ii) SEAMTRACK sending you a new product to replace the previous one. In all cases, you must send the faulty devices to SEAMTRACK and must have reported the issue to SEAMTRACK in writing, at the address indicated above, within fourteen (14) calendar days of the product delivery date.
- This provision does not affect any statutory rights you may have. Limitation of liability.
- Liability for any losses you may suffer as a result of a breach of the Contract by SEAMTRACK shall be strictly limited to the amount you have paid for the service.
- However, the above limitation shall not apply to the following:
(a) Death or personal injury caused by our negligence;
(b) Wilful misconduct and/or gross negligence.
(c) Fraud or misrepresentation, or
(d) Any other case in which it would be unlawful to exclude, or attempt to exclude, our liability.

General
- SEAMTRACK may transfer, assign, charge, subcontract or otherwise dispose of the contract, or of any of its rights or obligations arising from it, at any time during the term of the Contract.
- A declaration by a Court or an Arbitrator that any term, condition or paragraph of this contract is null or invalid shall not affect the validity or effectiveness of the remainder of the Contract. -These Terms shall be governed by and construed in accordance with Spanish law. For the resolution of all disputes arising from these Terms, or relating to the breach, interpretation, termination or validity of any provision of these Terms, the parties, by mutual agreement, submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, expressly waiving any other jurisdiction that may otherwise apply to them.

We accept no liability whatsoever for misuse or improper fitting.
